Scope notice
Provider: Robert Santiago / hegyon.ai. Subject: multi-LLM chat for personal use ("Public Chat"). Contact: legal@hegyon.ai.
These Terms apply exclusively to private, non-commercial use of the Public Chat by consumers. For business use of the hegyon.ai platform (CRM, ERP, HR, project management, etc.) and for Enterprise tiers, the separate B2B Terms of Service and the Data Processing Agreement provided for there apply. In case of conflict, these Terms prevail for private use.
1. Acceptance and conclusion of contract
By actively confirming these Terms during registration or when first using the Public Chat, you enter into a usage contract with us. If you do not agree to these Terms, you may not use the Public Chat.
2. Minimum age (18+)
The Public Chat is intended exclusively for persons aged 18 and over. By using it, you confirm that you have reached the age of 18 and have full legal capacity. If we become aware that an account is operated by a minor, we are entitled to suspend and delete the account.
3. Description of the service
The Public Chat is an AI-powered multi-provider chat for personal use. You may submit queries ("prompts") and receive responses ("AI outputs") generated by selected external Large Language Model providers ("LLM providers"), optionally enriched with web research and source citations.
The functionality available depends on the tier you select; see the pricing page for details. We may add, modify or retire functionality; if a paid tier is materially impaired, section 11 (pricing / termination) applies.
4. Nature and limits of AI outputs
- AI outputs are generated automatically and may be incorrect, incomplete, outdated or misleading ("hallucinations"). You may not rely blindly on AI outputs and are responsible for reviewing them before any use.
- AI outputs do not constitute legal, medical, tax or financial advice and do not replace professional advice.
- Sources and third-party content shown via web research are subject to third-party rights (in particular copyright). You are responsible for any further use of such content.
5. User account
You may need an account to use the service. You are responsible for the confidentiality of your credentials and for activities under your account. Please notify us immediately of any unauthorised use.
6. Acceptable use
You undertake not to use the Public Chat to:
- pursue unlawful purposes or violate applicable rules;
- transmit malicious code or disrupt the service;
- obtain unauthorised access to the service or its systems;
- circumvent security or content filters;
- generate or distribute content that violates the rights of third parties, or harass, threaten or harm others;
- scrape, mirror or systematically duplicate the service, or resell or commercially exploit it.
7. Your content and AI outputs
- You retain all rights in your inputs (prompts, uploaded content). You grant us a non-exclusive right to process them solely for providing the service, ensuring security and integrity, and complying with legal obligations.
- AI outputs are made available to you for your personal use. We make no warranty that they are accurate, original, non-infringing or fit for a particular purpose (cf. section 4).
8. Data protection and data transmission
- Role. For personal data processed in connection with the Public Chat (in particular account, usage and chat data) we are the data controller within the meaning of the revised Swiss Federal Act on Data Protection (revFADP). Details are governed by our Public Chat Privacy Notice.
- External LLM providers / cross-border transfer. To provide the service, inputs are transmitted to external LLM providers, some of which are located outside Switzerland, in particular in the United States. The current list of providers used and the applicable transfer mechanism (EU-US Data Privacy Framework / Standard Contractual Clauses with Swiss addendum / adequacy decision) is maintained on the Trust Center.
- Data minimisation before transmission. We apply technical safeguards that aim, on a best-effort basis, to reduce or pseudonymise directly identifying information before transmission to LLM providers. These measures do not constitute full anonymisation; re-identification cannot be excluded. Transmitted data remains personal data and remains subject to the safeguards under section 8.2.
- No training on your data. We do not use your content to train our own models. The external LLM providers used are bound by no-training agreements.
- Your rights. You have the rights granted by the revFADP (in particular access, rectification, erasure and data portability). Requests can be addressed to the office indicated in our Public Chat Privacy Notice.
9. Liability
- Mandatory exceptions. These Terms do not exclude or limit liability where doing so is not permitted under mandatory law, in particular for intent and gross negligence (Art. 100 CO), for personal injury, and under the Swiss Product Liability Act.
- Scope. Subject to section 9.1, in providing the free or low-fee Public Chat we are liable only for damages we have caused culpably; for slight negligence we are liable only for breach of material contractual obligations and only up to the damage foreseeable under the contract type.
- AI outputs. We are not liable for consequences arising from your use of an AI output without review (cf. section 4).
- Backups. You are yourself responsible for backing up content you consider important.
10. Intellectual property
The platform, its software, models (which we own or have licensed), designs, documentation, and the trademarks "hegyon", "hegyon.ai" and our logos are and remain the property of Robert Santiago / hegyon.ai or of our licensors. You receive a simple, non-transferable right of personal use limited to the term of the contract. Reverse engineering is permitted only to the extent mandatory Swiss law allows it.
11. Prices, subscription and termination
- Tiers. Available tiers and prices (in CHF) appear on the pricing page.
- Termination at any time. You may terminate your subscription or account at any time. Termination takes effect at the end of the current paid billing period; pro-rata refunds are not given unless required by mandatory law. Termination is at least as simple as conclusion.
- Price changes. Price changes for future periods are announced at least 30 days in advance. You may terminate effective at the time of the change.
- Default on payment. In the event of payment default we may suspend access after a reasonable reminder.
12. Suspension and termination by us
We may suspend or terminate access for violation of these Terms. Upon termination your right of use ceases. Provisions that by their nature continue to apply (in particular liability, intellectual property) remain in force.
13. Changes to these Terms
We may update these Terms. We will inform you of material changes in advance in an appropriate manner. If you do not object within the notice period, or continue to use the service after it, that constitutes consent; otherwise you may terminate pursuant to section 11.2.
14. Applicable law and jurisdiction
Swiss law applies. The place of jurisdiction is Zürich, subject to any mandatory consumer forum at your domicile.
