What Brussels has to publish on Monday
Two things are due on 2 February, and one of them is genuinely useful. Neither requires anything of a Swiss SME.
2 February 2026 is a date in the AI Act. The Commission is expected to publish guidelines on how high-risk systems are classified, and to carry out its first review of the prohibited practices that took effect a year ago.
Expect coverage next week. Here is what it will mean.
The guidelines: useful, indirectly
The high-risk classification has been the most confused part of the Act since 2024. Guidelines on how Article 6 works in practice are what suppliers, auditors and procurement departments have been waiting for.
You will not read them. What you may notice, over the following months, is that customer procurement questionnaires get more precise, because the people writing them will finally have an authoritative reference. That is a mild improvement in your life and it arrives in the second half of the year.
The review: watch, do nothing
The prohibited practices — the short list of uses banned outright — came into force in February 2025 and are subject to a first review. The list could grow.
The practices concerned are things like social scoring and certain kinds of biometric inference. If your company is doing any of them you already know, and this blog is not where you would find out.
The wider picture, which has not changed
The high-risk obligations themselves are the ones Brussels proposed on 19 November to defer past August 2026. So Monday produces guidance about a regime whose start date is itself under negotiation.
That is an unusual situation and it is the reason this blog has repeatedly advised against buying compliance products against these dates. Guidance is useful; a deadline that moves while its guidance is published is not something to spend money on.
Your actual position on Monday
Unchanged. Swiss data-protection law applies as it did last week. Your supplier documentation links from August are still the answer to a procurement question. And the only date on your calendar that does anything is your own renewal date.
